According to the order of the Ministry of Health of Ukraine № 188 from 01.08.2000, as amended on 29.07.2010. “On approval of tables of small, large and especially large sizes of drugs, psychotropic substances and precursors in illicit circulation”, drugs are cannabis:

  • Cannabis resin (hashish, anasha),
  • Cannabis oil,
  • Tinctures and extracts of cannabis,
  • Marijuana (dried and not dried),
  • Plant tips with flowers or fruits, except for ripe seeds from which no resin has been isolated

Thus, hemp seeds are not a drug of their own and their sale and/or purchase does not entail administrative or criminal liability, as there is no crime.

The concept of “assistance in the cultivation of psychoactive plants” does not exist in Ukrainian legislation and, as a result, there is no responsibility for it.

Based on this, you are fully personally responsible for any actions taken later, with the purchased seeds.

For buyers not from Ukraine:

We can not guarantee the successful passing of customs control when sent to other countries. In case the goods will be confiscated (the envelope will have clear traces of opening and marks about it) – no compensation is paid !!

We are located in the territory of the jurisdiction of Ukraine, here the Ukrainian legislative base in the field of regulation of drug trafficking is described.

The legislative base of your country may differ in these matters, check everything yourself or get competent advice before ordering our products.

Sowing and growing hemp

There are two types of liability for violations in this area – administrative and criminal.

According to Article 106-2 of the Code of Administrative Offences of Ukraine, illegal sowing or illegal cultivation of hemp in an amount up to 10 (ten) plants are punishable by a fine of 306 to 1700 UAH with confiscation of illegally cultivated plants. In this case, a police officer shall draw up a protocol on administrative violation, on the basis of which a court decision is later imposed a fine in the specified amount from the culprit.

If the number of cultivated plants exceeds 10 (ten), this is already a criminal liability. According to Article 310 of the Criminal Code of Ukraine, illegal sowing or illegal growing of hemp in the amount of 10 to 50 plants are punishable by a fine of 1700 to 8500 UAH, or arrest for up to 6 months, or restriction of liberty for up to 3 years. This crime is a crime of minor gravity and therefore no imprisonment is entailed.

At the same time, a person who voluntarily surrendered drugs and indicated the source of their acquisition or contributed to the detection of crimes related to their illicit trafficking is exempt from criminal liability for their illegal production, manufacture, acquisition, storage, transportation, shipment.

Under article 310 of the Criminal Code, the illegal sowing or illegal cultivation of hemp by a person who has previously been convicted under that article or who has previously committed one of the offences under articles 307, 309, 311 or 317 of the Criminal Code, or the offence is committed by prior conspiracy of a group of persons for the purpose of sale, as well as the illegal sowing or cultivation of 50 or more cannabis plants, entails deprivation of liberty for periods of between 3 and 7 years.

According to the established judicial practice, the crime stipulated by the above mentioned article of the Criminal Code is recognized as such from the moment of sowing seeds or planting sprouts, as well as from the moment of taking actions for the care of plants, regardless of achieving the set goal. If for reasons independent of the will of the “gardener” (frost, drought, etc.) the seeds have not sprouted or the plants have died, then even in these cases the crime is recognized as committed.

In this case, when calculating the number of illegally cultivated plants according to the established court practice, a separate plant is considered to have an independent root, and the number of its stems is not taken into account.

The actions of persons who have illegally planted or cultivated a drug, and then stored, transported, and sold the processed drug are qualified in court practice as a set of crimes, which entails even more severe sanctions.

Also noteworthy is Article 315 of the Ukrainian Criminal Code, under which inducement to use drugs is a crime and entails a restriction of liberty for up to five years or deprivation of liberty for two to five years. Judicial practice has established that inducement to use drugs is a non-violent act (request, persuasion, offer, persuasion, coercion through intimidation, etc.) aimed at arousing a person’s desire to use drugs at least once. However, the responsibility under this article comes regardless of the outcome – whether the person used drugs or refused.

Can I claim for non-germinated seeds?

Yes, of course. Before producers, we’ve been growers and so we know how frustrating it is when those seeds you have so eagerly bought don’t germinate as they should. For those few non-germinated seeds, we have a 3-month replacement guarantee (from receipt of order), not applicable to freebies.

The replacement of non-germinated seeds by Fast Buds Seeds, Dinafem Seeds and Humboldt Seed Organization are dealt directly with the corresponding seed bank. When it comes to the other seed banks, we replace those seeds by our own seeds in order to speed up administrative procedures for the sake of our customers.

All you have to do is get in touch with our Customer Service Department writing to [email protected], indicating your delivery note number or order number and explaining which germination method you have used. If you have used an adequate germination method, you may be asked to send us some pictures of the seeds to see if the problem clearly lies in them. If so, we will replace them as quickly as possible.
